WAYNE — A North Carolina man is in custody, one month after police say he stabbed a man in western Wayne County.
Authorities in Texas arrested Jimmy Russell Davis on Monday without incident. Court documents state the 47-year-old from Angier, N.C., is wanted for murder in connection with a May 26 stabbing in Crum.
Davis also faces a sex-related charge in Harnett County, N.C., south of Raleigh.
Michael Smith, 43, died at St. Mary’s Medical Center several days after the stabbing. Police said the victim did not immediately seek medical attention.
The stabbing occurred May 26 at a residence on Crum Hollow Road. West Virginia State Police did not learn about the stabbing until June 3, when family members filed a malicious wounding complaint.
Smith was never discharged from the hospital. He died June 5. A state medical examiner said the victim died as result of the stabbing, according to a criminal complaint filed in Wayne County Magistrate Court.
The criminal complaint states Smith and Davis became involved in a heated argument at the Crum Hollow Road residence.
The defendant left the home, but stabbed Smith during a return visit a short time later, according to the complaint. The victim sustained wounds to his chest and forearm.
Investigators believe the attacker used a knife, the complaint states.
West Virginia State Police First Sgt. A.L. Cummings said investigators had information that Davis was in Texas prior to Monday’s arrest.
Davis waived extradition at a hearing Tuesday in Brazoria County, Texas. It is located south of Houston. He was being held without bond Wednesday on the two fugitive charges, according to a records clerk at the Brazoria County Jail.
Authorities will formally charge Davis when he returns to West Virginia and North Carolina. No word on which state will prosecute Davis first, Cummings said.
The North Carolina warrant accuses Davis of indecent liberties with a child. The felony warrant dates back to February 2007, according to court records and the jail’s clerk.
