Steps to enforcement
The state Alcohol Beverage Control Administration issues alcohol licenses and investigates complaints. Violations can be issued for public safety concerns, drugs and underage consumption. Permitting any criminal activity also violates state regulations.
- EVIDENCE: Investigators from the state Alcohol Beverage Control Administration work with local police to gather evidence and information. ABCA officials are careful not hinder the police effort. Then investigators review the evidence.
- DETERMINATION: State officials determine if any violations occurred and the appropriate punishment. Punishment may be a fine or immediate suspension of the nightclub's alcohol license. The suspension gives officials time to consider a possible revocation.
- COURT: The nightclub owner(s) can appeal any suspension. An administrative law judge hears evidence from both sides. State officials also need a hearing to win a revocation. In some cases, the nightclub will surrender its license.
