W.Va. group seeks to stop Fola Coal mining permits

HUNTINGTON — Plans to open two West Virginia mountaintop removal mines are being challenged in federal court.

A hearing is scheduled for next Tuesday on the Ohio Valley Environmental Coalition's attempt to halt the construction of two valley fills at mines planned by Fola Coal Co.

The group says the permits are flawed because the U.S. Army Corps of Engineers failed to follow federal law when issuing them

Lawyers for the coal company have filed a separate petition saying the permits adhere to changes required in a 2007 federal court ruling regarding corps-issued permits.

That ruling required the corps to conduct additional reviews when issuing valley fill permits for mining operations.
