Sentencings set in case tied to US marshal's death

ELKINS, W.Va. (AP) — Three people linked to the fatal shooting of a deputy U.S. marshal will be sentenced next month.

The Exponent Telegram says U.S. District Judge Joseph Goodwin will sentence them Feb. 28 in Elkins.

Prosecutors charged all three with lying to federal agents seeking a fugitive who later died in a gun battle along with marshal Derek Hotsinpiller.

Forty-eight-year-old Sherry Smith, her 25-year-old daughter Cassandra Smith and her daughter's boyfriend, 24-year-old Anthony Lambert, all pleaded guilty to similar charges last year.

Sherry was married to fugitive Charles Smith. She now goes by Sherry Lou White.

Goodwin normally presides in the Southern District of West Virginia, but he's replacing Judge John Preston Bailey.

Bailey was recused in December after another court ruled the change was in the public interest.
