Court rules pardons apply to only criminal cases

FRANKFORT, Ky. (AP) — The Kentucky Court of Appeals has ruled that governors’ ability to issue pardons is limited to criminal cases.

The Lexington Herald-Leader reported the ruling was released Friday. It allows the Executive Branch Ethics Commission to continue an ethics case against Basil Turbyfill, the former director of the Governor’s Office of Personnel and Efficiency.

Former Gov. Ernie Fletcher had pardoned Turbyfill in a criminal case, but a three-judge appellate court panel ruled the pardon doesn’t apply to the ethics investigation.

Turbyfill was one of several Fletcher administration employees who were charged in a state hiring scandal and later pardoned by Fletcher.
