Judge: Ky. Medicaid expansion can move forward

FRANKFORT, Ky. (AP) — A judge has ruled that the expansion of Kentucky’s Medicaid program can continue while the court considers a legal challenge brought by the tea party.

The Courier-Journal reports a judge on Friday ruled against an injunction to stop the federal Affordable Care Act that would add about 308,000 beneficiaries to the Medicaid rolls next year.

Tea party activist David Adams filed a lawsuit over the move and sought a temporary injunction to stop the expansion.

Judge Phillip Shepherd said in his order that the case should conclude by October, which is before the expansion is planned.

He said if the lawsuit is successful, there would be time for relief before the expansion is implemented.
