Man sentenced in abuse case

January 13, 2012 @ 09:29 AM

HUNTINGTON — A 41-year-old man accused of doing harm to an incapacitated adult will spend a few months in prison.

Darren Canada received his punishment Thursday in the form of a 1- to 3-year prison sentence. The decision was handed down by Cabell Circuit Judge Alfred Ferguson.

Canada of Huntington had entered a plea late last year convicting him of attempt to commit a felony. A September 2010 indictment initially charged Canada with felony second-degree sexual abuse and abuse/neglect of an incapacitated adult.

Cabell County Sheriff Tom McComas said the incident stemmed from reports of a heath care worker abusing a female resident at Chateau Grove Senior Living near Barboursville.

The prosecution said Thursday that Canada’s plea was in the best interest of justice considering evidence in the case.

The victim has since passed away. A family member spoke Thursday on her behalf.

Ferguson’s punishment marked the maximum sentence. However, the judge told her family that Canada could fulfill his sentence in a period of months when given credit for good behavior.

McComas praised the nursing home for their cooperation.
