Man with learners permit charged with DUI causing death
WAYNE -- A 20-year-old man driving with a state learners permit now faces a felony charge for causing an accident that killed his passenger and injured five others.
Jarrett Waylin Hawks of Wayne was arrested Wednesday, Sept. 1, and charged with felony driving under the influence causing death. He also faces six counts of misdemeanor drunken driving causing injury.
The charges stem from a July 9 crash near W.Va. 152 and Midville Heights. It damaged three vehicles and injured six people. Both of the passengers in the vehicle were injured. William Arthur Dan Followay Lackey, 21, died from his injuries.
Criminal complaints charge Hawks' toxicology report found the presence of alcohol and marijuana. That report was released to investigators at the urging of the Wayne County Sheriff's Office and Prosecutor's Office July 12.
The complaints charge Hawks told police his shoelace got tied around the brake pedal. His vehicle then hydroplaned, crossed the center line and struck another vehicle. He then remembered seeing the arm of his surviving passenger trapped in the vehicle.
Survivors of the three-vehicle crash received various injuries, the complaints state.
Investigators could not locate a drivers' license for either of Hawks' passengers.
