Woman faces heroin charge

HUNTINGTON -- The U.S. Attorney's Office has filed a heroin charge against a 33-year-old woman from Huntington, according to court documents.

Attorneys filed the federal possession with intent to distribute charge Monday against Tina Simmons.

The charging document alleges that Simmons knowingly and intentionally possessed heroin on Aug. 16, 2007.

A similar crime on the same date led to Simmons first being charged in Cabell County Magistrate Court. The initial case was dismissed for possible presentment to a grand jury, according to court documents.

This week's federal charge was filed in the form of an information, which typically indicates the defendant has agreed to proceed without a grand jury indictment.
