INDICTMENTS: October 2008 Cabell County Grand Jury

The recent Cabell County Grand Jury has returned the following indictments. The charges were unsealed Thursday morning. An indictment is merely a formal accusation of guilt, and accused defendants are presumed innocent unless proven guilty.

  • Barry Lee Ayers (8 Simpson Drive, Huntington): arson first degree.
  • Michael V. Cummings (4245 Magazine Ave., Huntington): five counts of first-degree sexual assault.
  • Jessie Allen Dunfee (2110 8th Ave., Huntington): burglary, destruction of property and conspiracy.
  • Judy Mae Edwards (404 Prospect St., Huntington): counterfeiting, conspiracy and three counts of possession of a controlled substance with intent to deliver.
  • Jason Edward Fielder (4644 U.S. 60 E., Huntington): three counts of delivery of a controlled substance.
  • Johnnie Lee Holley III (227 10th St., Lot 7, Huntington): receiving stolen property.
  • Aaron Scott Midkiff (1509 Sycamore St., Kenova): two counts of grand larceny, two counts of receiving stolen property and two counts of transferring stolen property.
  • Billy J. Pelfrey (WRJ, One O'Hanlon Way, Barboursville): two counts of retaliation against a witness.
  • James Arley Smith (4008 Riverside Drive, Altizer, Huntington): grand larceny and obtaining money, goods or services, by false pretenses.
  • Mark A. Sowards (No. 4 Gloucester Court, Barboursville): robbery and malicious wounding.
  • Zenna Ann Spitler (104 Private Drive 3, Apt. 5, Chesapeake, Ohio): counterfeiting, conspiracy and possession of a controlled substance.
  • Dusty Ray Vance (Route 3, Box 281, Milton): burglary, wanton endangerment, assault during the commission of a felony and possession of a controlled substance.
  • Anthony R. White (210 Laverne Court, Mt. Washington, Ky.): counterfeiting, conspiracy and possession of a controlled substance with intent to deliver.
