Woman charged with providing gun in bar shooting

November 14, 2009 @ 12:00 AM

HUNTINGTON -- A 22-year-old woman from Huntington is charged with supplying the gun a Michigan native is accused of using to shoot a local man during an altercation last weekend at a 4th Avenue nightclub.

Nicole Gutierrez Hughes was arrested Thursday after investigators visited Marcum Terrace, the same neighborhood in which she lives. Hughes was charged with felony accessory before the fact to attempted murder.

A criminal complaint obtained Friday charges that Reginald Marbury told police "Hughes brought him the gun he used just prior to him shooting Sontezz Lomax."

Marbury, 25, of Huntington, and Lomax, 29, were two of four men shot during the exchange of gunfire early Sunday at Club Babylon, 831 4th Ave. Marbury was charged with attempted murder and accused of firing several rounds, two of which struck Lomax. Police have said three men were wounded, Marbury and Lomax and Christopher Lewis, 28, originally from Thurmond, Ohio.

Another man, Joe Jeremaine Porter, 30, of Huntington, died after being shot by a police officer at the nightclub. Police have said the officer, who has not been identified, shot Porter when he pointed a gun in the officer's direction.

Marbury and Hughes are being held at the Western Regional Jail. Marbury was detained pending the posting of a $103,000 bond. Hughes' amount was $10,000, according to court documents.

Huntington Police Chief Skip Holbrook said they were the only ones charged in relation to the downtown shooting as of midday Friday, but he expected more arrests. He acknowledged Hughes' arrest Friday, but said he was unaware if she was the only person detained during the visit to Marcum Terrace.

Holbrook declined further comment about the ongoing investigation, including when asked about any property seized during Hughes' arrest. His investigators are still conducting interviews and awaiting ballistic test results from a federal laboratory in Maryland.

The Club Babylon shooting happened about 3 a.m. Sunday.

According to police, Marbury, Lomax and Lewis were already wounded by gunshots when officers responded to reports of gunfire at the club. Police have said Porter was one of two people attempting to leave through the rear exit as police entered the nightclub.

Holbrook said the second person was present when Porter's shooting occurred. The chief said that person, whose name has not been released, was detained for questioning and later released.
