Former Hurricane councilman indicted
HURRICANE -- A former Hurricane City Councilman was formally indicted earlier this week on charges that he solicited a minor via computer.
Scott Allen Cunningham, 31, was indicted in Putnam County on Wednesday on two counts of soliciting a minor using computer.
Cunningham, who was elected to the council in June 2011, was arrested last June. He tendered his resignation as councilman the day of his arrest.
According to a criminal complaint filed with the West Virginia State Police, Cunningham had sexually explicit conversations with a 13-year-old girl via text.
The victim's father gave consent to turn the girl's phone over to the West Virginia State Police digital forensics laboratory earlier this month, which turned up numerous sexually explicit texts from Cunningham, including asking the girl to take a nude photo of herself, from May 2011 and May 2012, the complaint said.
If convicted, Cunningham faces two to 10 years in prison and a fine of up to $5,000.
