Man sues Kenova police over arrest
HUNTINGTON -- An Ashland man once charged with but later deemed innocent of robbery is taking the city of Kenova, two police officers, a carryout owner and her employee to federal court.
An attorney for Kevin Shannon filed his lawsuit Nov. 13. It seeks awards to cover punitive damages, attorney fees and court costs associated with Shannon's jailing in August.
The Kenova Police Department had arrested and charged Shannon in connection with an early morning, Aug. 12, armed robbery at Miss Daisy's Carryout. The carryout, formerly known as the Midget Carryout, is located at Oak Street and 21st Street.
Authorities said someone had entered the business and used a gun to commit robbery. Shannon was arrested and booked into the Western Regional Jail. The lawsuit says the assailant fled with $777 cash.
The lawsuit claims Shannon was arrested based upon a description and identification provided by an employee of the carryout. He was detained for six days. The case was then dismissed in Wayne County Magistrate court based upon insufficient evidence to maintain the charge, the lawsuit states.
The lawsuit claims the city of Kenova failed to train its officers in regard to providing exculpatory evidence to prosecutors. It also blamed the city for the officers' alleged negligent and intentional actions.
The officers were identified as M.P. Clark and B. Willis.
The lawsuit accuses the carryout owner with failing to properly train and supervise the employee.
Kenova Mayor Ric Griffith declined comment when contacted earlier this week. No response had been filed as of Friday on behalf of any of the defendants.
