Hearing set on FOIA complaint against court
CHARLESTON, W.Va. (AP) — A Kanawha County circuit judge plans to hear arguments on whether state Supreme Court justices are subject to West Virginia’s Freedom of Information Act.
The case was filed by The Associated Press after the high court denied an FOIA request for e-mails, visitor logs and other documents held by Chief Justice Elliott “Spike” Maynard.
The AP filed an FOIA in January seeking any communication between Maynard and Massey Energy chief Don Blankenship as part of its coverage of Maynard’s July 2006 European vacation rendezvous with Blankenship.
Massey had several cases pending or headed to the state’s highest court at the time.
Kanawha Circuit Judge Duke Bloom delayed the case in May so he could decide if he could issue a ruling covering the high court.
